What is the Case 3: 'Falsos positivos'?



6,402 people in Colombia were presented as guerrillas killed in combat when they were not. This provisional figure was established by the Chamber for the Recognition of Truth between 2002 and 2008, after comparing the versions given by those who appeared before the JEP with the files of the Public Prosecutor's Office, the reports of the Attorney General's Office, the figures of the Accusatory Criminal System, the Observatory of Memory and Conflict of the National Centre for Historical Memory and the Colombia-Europe-United States Coordination (CCEEU).

One of the reports analysed is that of the Centro de Investigación y Educación Popular (CINEP), provided by the magazines Noche and Niebla. It documents 1,741 crimes committed by victims of "false positives" between 1984 and 2011. Similarly, the Colombia-Europe-United States Coordination (CCEEU) has provided the JEP's Executive Secretariat with a database of almost 1,257 other victims of this phenomenon, allegedly killed between 2006 and 2008.




The Public Prosecutor's Office identified 2,248 crimes of this type between 1988 and 2014. With this information, the JEP began to hear the testifiers and to build Case 03. According to Order 033, the investigation of Case 03 is carried out "from the bottom up". This means that first of all, the key players and those most responsible at regional and local level are identified. Then, on the basis of the factual and legal framework of this first phase, it will be determined whether there is a crime and who is most responsible.
